NCAA response to Carolina...NO Merit to any of your aarguments

we already are lawyered up. the ncaa knows they put themselves squarely in a box the second they used the arguement that we dont control academics in the o'bannon case. they have to hope unc plays ball or this will get ugly for them.

My lawyer buddy said this is not good for UNC. Said that the NCAA isn't rolling over like UNC thought they would.

i am no lawyer but it looks like a negotiation tactic to me they already sent an anoa. which to the shgrrin of all the prognosticators that want unc bball dead pretty much cleared men's bball and football can't be punished twice for the exact same crime. this is about hammering women's basketball which will happen unc just wants t o look like it is defending our women's program imho.

Personally, I think it's high time the NCAA was openly challenged. No school has ever been more forthcoming and cooperative. It's time their unlimited power was challenged.

However, if it is deemed that we lack institutional control then they can hit football and bball.

i love the part in ther when unc says statute of limintations was up the ncaa says willful cheating on this case makes an exception. Law is black and white I can't arrest someone and charge them with felonies on drugs dating back 10 yrs and say well their willful law breaking made an exception

this is true but how many colleges charged with that had all their sports hit. i think out women's program is going to end up with the short end of the stick on this. the ncaa is just setting that up. i would almost guarantee it.

Gonna be some folks down to the firm earning some big bucks in 32 days.
I am hopeful our team will skewer their group and the NCAA.
I'd say take the 12 gauge, bore it out to 7 shots and show up at Hearing.
I agree with Archer, show up and do the show. Challenge the heck out of them. Make them regret going after member institutions. That and don't send them any more dues!

Correct me if I'm wrong, but didn't ESPN report the NCAA had some sort of meeting regarding our investigation, and Roy wasn't there (or invited) back in September?

I'll link the article if I find it.

EDIT: That was easy

Who cares. This already happened with Auburn and Michigan and they did nothing.

Past precedent has already been sent and if it goes before a court that will matter.
Auburn's situation has less than zero to do with this case. There was never any allegation there concerning academics or anything remotely substantial about institutional involvement or control.

That's fair. They're taking on the jurisdictional claims, which shouldn't be unexpected since it is a direct challenge to some of their enforcement powers.

Not necessarily correct.

If your buddy ever represents you in a court of law, I sure hope he does it pro bono . . .

Folks . . go back to post #13 of this thread, (Heelmanwilm's) . . he's dead on as to how this legal game is being played out by both sides.

btw, when that man posts something, you may want to pay attention . .

Guys relax. All he said was if UNC thought the NCAA was just going to accept the amendments they are very wrong.

Totally inconsequential. What unc did was basically a move to have charges dismissed ploy used by allnlawyers in a court. It rarely works and basically just returns the status of the case to where it was prior. No damage done.
heelman I feel smarter just in reading your post. Thanks

Right, and now it goes to the COI like it was going to anyway, right? This was basically just a 'hey, we are going to continue with the path we were already going down and don't really accept your contention that we can't rule on this'. The amended NOA is still just that and what the COI goes off. Is that correct?

I think the NCAA has met its match. They took on the wrong crowd with UNC and we ought to attend the COI and fight them in any applicable Federal Court until the NCAA becomes an asterisk.

Pretty sure UNC has dug in it's heels and intends to fight. If the NCAA tries to over-step it's mandate they are going to end up in court and recent rulings have proven they are as toothless as most kaintuck fans.

Right now this is posturing with each party showing their most strong position, usually what comes from things like this is a compromise, pretty much what lawyers do. I think in the end the school will get a hefty fine and the women's program gets hit, maybe hard.
