The Kerwin Thread is trending towards being hijacked.... so I thought maybe we can discuss NIL here and leave that thread to Kerwin....

From my understanding, NIL was meant to allow athletes to benefit from their Name, Image and Likeness. Essentially providing income based on the billions they generate.

Early in the piece athletes did that, to varying degrees.... Mando sold his burgers and the twin girls from California made millions on instagram out of horny middle aged men.

It's now become apparent that schools themselves are engaging in the sourcing of such NIL in an out-of-control bidding war for players' services.... Case in point - the reported $400k being offered to Kerwin, a barely used UNC reserve.

Now we're seeing players threatening to move schools if they're not 'paid' enough (Isaiah Wong at Miami). And the follow up from the man i assume is his main 'sponsor', Ruiz saying he won't renegotiate.

It's definately a murky situation which will be taken advantage of in all sorts of ways (this is capitalism of course). But it also provides great life experiences for these athletes.... Say Wong leaves Miami and then doesn't secure a better deal? Say a player "does a Ben Simmons" and refuses to play... and then gets pay stripped from him/her? And lets not forget, NIL is not tax free (unlike the good-old brown paper bags of yesteryear) so players and their families will now need to manage finances, spend appropriately and, gulp, save what they can if they don't have pro-sport prospects once the 4yr gravy train stops.

Plenty to discuss.... keen to hear thoughts.

Depressing for sure. The good old days I’m afraid are gone. I just hope the NIL and it’s unintended consequences don’t wane my enthusiasm for all things Tar Heel related.

Agreed…. It’s a two edged sword which has put UNC into a power position for next year… but who knows what the future holds…. Pretty sure the current ‘free agency’ mess wasn’t intended.
One thing to help… NCAA could do away with the portal exemption.

Pandora‘s box has been opened. Players will be looking to attend institutions that have infrastructure and support systems to help them maximize their NIL potential. UNC has to be at the forefront of this. It’ll be ripe for total chaos. Tampering galore.

Did the university not just sign a deal with a company that will send you memorabilia for a subscription where the money goes to NIL. Are we not going to have a nightmare with another title nine situation when pay is unequal? Definitely already on a slippery slope
 
hopefully the incoming NCAA Prez (in 2023) will reign things in a bit. they definitely let NIL get started without enough regulation.

I just saw where the Big 10 new media package is now expected to reach 1 BILLION. Sheesh, so much money rolling in !!!!!

Wonder how congested it will make future drafts, when people run out of eligibility and all bolt in the same year. Only a certain amount of space in the 1st round
 
We hear about "unintended consequences." But it is beyond me how the PTB could not have seen the chaos coming. Were they that naïve or out of touch with human nature? The consequences may have been "unintended," but they were/are inevitable.

Perfect example of how worthless the NCAA (the governing body) actually is. They have nothing but acknowledge that NIL is now allowed. They have provide no guidelines so schools literally do not know what is allowed and what isn't? Isn't it Miami boosters that are giving pay checks out to ALL of its football players and then the Wong song, I deserve more than anyone else on this team?

How long before NCAA players unionize, as is the case with all pro sports, to demand their % of all revenues? NIL is not supposed to be pay for play, NIL is supposed to allow college athletes make money off of endorsement deals, as is the norm for pro sports. But the individual teams do not set up your endorsement deals, you contract with an agent and that agent sets up the endorsements. But what is happening now in the NCAA is the programs are not just involved in setting up the endorsement deals but are making it clear you only get this deal is you play for us? That is pay for play and it defines the player as a employee of the school and the NCAA guidelines clearly say that is still a violation. But how can it be a violation if schools do not know if setting up a pay for play deal will be punishable by the NCAA. While the NCAA sits on their hands and provide no guidelines, programs face the reality of either breaking NCAA rules or abiding by them and be at the disadvantage of not being able to get the talents because they are being bought and paid for to go elsewhere?

This was all avoidable simply by issuing clear guidelines of what is and what is not allowable but the NCAA could not be bothered with such things and hey, they are making millions for doing nothing so why change that? Blame lays with the member programs ADs and coaches for allowing this BS, for not holding the NCAA governing body feet to fire. Crime happens when there are no cops to keep it in check. Seems like the only NCAA cops that exist are crooked and that makes them no better than the crooks!

Now that paying players is done everywhere and seeming legal do the Duke and Kentucky recruits get to renegotiate their deals that got them signed. They might have to take a pay cut in order to pay taxes. Thinking about this I figure the low or no tax states will probably dominate the polls in the future? Why go to UCLA when you can go to Florida and pocket that much more.

I'm not sure how much power the NCAA has to govern NIL. They already lost to the Supreme Court once, when trying to fight it.

As far as NIL & UNC goes, my biggest concern is that players may get distracted with money making endeavors & not concentrate as much on their game. Only time will tell.

I think you are absolutely correct. It is a business. That's why it is insanity. Perhaps it has been a business for some time but as a long time fan I remember the day not that long ago when the only business in town related to this was the NBA.

Shame we know that this is just leading to another board that only takes care of NIL. They could become new NCAA. I would not be surprised if most associated are the same people.
 
Where is that self-appointed know it all Bilas???? HE was the guy for years bloviating about the need to pay players. Well, he has what he wanted.... CHAOS!!! Get this dookie on some interview and let me see him try to justify the crap he has helped to create. Oh yeah he is too busy playing golf and has not said a word.
 
I'm not sure that this is chaos though. It is different, for sure, as they adjust to using a free market, but that is to be expected. It also is having some very positive immediate affects. Kids with professional aspirations actually seeing college as a viable option to grow their game in now for their chosen field.

Change is scary I know.
 
I think you are seeing the high point of NIL right now. One way, or the other, it will calm down. And right now, it isn't about name, image, and likeness. You are basically collecting money for free agency with players going to the highest bidder. And most schools are relying heavily on the fan base to contribute to a collective. And many are at this point. But all but the very wealthy already spend a good amount of money on a contribution to a booster club for the right to buy tickets. Then the tickets and the parking pass don't come for free. And for their money, folks are going to demand an elite program. If they don't have one, folks are going to stop throwing money at a program that doesn't produce. Now the players wanted a piece of the pie, and be part of the business. That's fine. But there are two sides to that equation. And right now the players have the best of both worlds. They get their money, but then if they don't feel they are enough of a star at their current school, they simply just pack their bags for the next highest bidder. It is time for contracts. Players can still leave anytime they want. But if one does, the should be contractually bound to pay back every cent of NIL, and scholarship, money they received to the school they are leaving. After all it is what they wanted, a business. And business is a two way street.

They can't give clear guidelines when they can just get sued and probably defeated no matter what guidelines they make. The ruling for NIL was pretty sweeping and unanimous.

Yep, like most other things or viewpoints from people in general, as George Carlin said "ever notice how my sh#! is always good/important stuff, while other people's "stuff" is sh#!".

I fall victim as well. Seems like the people who complain the most about "people always whining and complaining" attribute that trait to "this generation, or that group, etc." Without realizing they are in the midst of said whining and complaining theirself, but that ain't whining and complaining it's "just calling it like they see it". 😆

Oh they absolutely can make crystal clear what the NCAA guidelines are for NIL, yes they can. It is or should be clear now, NIL is NOT, let me repeat that NOT supposed to be pay for play, pay for play is STILL supposed to be a violation.

ALL the schools should be allowed to do is educate players on NIL, have said for years there actually should be a degree dedicated to teaching college players about the pit falls and what they need to know about professional sports. Things like how agents take advantage, how much should agents get, just to name a couple items out of what is a huge list of things kids should be made more aware of.

Schools should have absolutely ZERO involvement in NIL deals their players engage in, boosters for a program should NOT be able to be a principle of a company offering NIL deals for a kid their school is recruiting unless it is proven that the kid can get that same NIL deal no matter where he plays. In fact, there should be a clearing house set up by neutral 3rd party that looks in to the deal and determines if it meets NCAA guidelines for NIL or is it a booster driven deal.

There are schools right now that are actively engaged in arranging the NIL deals and offering them to recruits and portal guys they want to play for their school, in no way should that be allowed and those teams doing that now, MIami for example should be hit hard for it. Duke, we already know thru recruits is selling NIL as their closing argument for comitting to them, that needs to stop and they need serious punishment for it. But does the NCAA have the set to rightfully punish duke, they clearly didn't while K was there but do they now that he is gone?

This is impossible to oversee. Local companies do not want players who are going to be in Utah if they are located in NC. Of course a chapel hill company wants an athlete that is going to chapel hill. If they say players have to be committed before they can offer NIL, then the current players will just publish all there NIL deals to show what you will get if you go to the school. Guess what, boosters own lots of companies and are the ones who legitimately want NIL deals to further their businesses. They don't even have to pretend. Miami isn't doing anything wrong, I don't think. They have a rich alum who owns a bunch of businesses that will benefit greatly from NIL. Come on Jordan. Every Carolina player gets a Nike deal and a He's not Here deal and a car deal. There are no rules that can contain this.

They will just get sued and lose. They are powerless. The ruling was pretty definitive and sweeping. It doesn't matter what they say, and they are more likely to get athletes ruled as employees than to enforce anything to limit it.
 
Keep in mind that the last thing to "escape" from Pandora's Box was HOPE!

I really HOPE this signals a change in the way the NCAA works, especially in the transparency and consistency of its enforcement of rules. Regulating this will force them to review all of their processes and become more efficient! OR lead to their complete demise!

NIL simply keeps the NCAA from having to enforce their own rules. I feel all the FBI investigations, all the allegations of backdoor sneaker money, and shady coaches will go away. Yes, players are getting paid, and some at ridiculous amounts. But it comes at a cost. The purity of the student athletes is gone. Everyone can hire mercenaries now, who can afford them.

If the NCAA struggled the "investigate" offending schools before, how could they possibly do that now? Their hammer of punishment is as hard as a Tonka Tool kit hammer, unless you are UNC.

I've heard so many times over the last 15 years or so why the world will come to an end... So and so was elected POTUS, the world is coming to an end. Everyone likes to be so dramatic about everything.

My 2 cents.

Something like NIL was long overdue. The athletes should be able to get compensated what someone is willing to pay them. But as with literally everything in this country, there will be bad apples and some people will take advantage of the system.

Like everything in this country, this is not the perfect system and it has its flaws. But if this system helped keep players like Bacot, Love, or that Oscar kid at UK for another year, I think it helps CBB more than it hurts.

Biggest concern for me is the NCAA leadership needs to be strong, organized, and competent to guide through this very unknown period. And the NCAA has no leadership, is weak, unorganized, and incompetent. That's the bigger concern to me. I don't really care if kids make a couple hundred grand or a few million bucks in college. If they find someone willing to give them that money, good for them.

Hell, they'll probably learn more because of this too. College education doesn't teach jack about financial literacy. This will hopefully gain some useful life skills for these kids and help plan for their future.
