EXCLUSIVE: An intelligence community review has re-affirmed that two classified emails were indeed “top secret” when they hit Hillary Clinton’s unsecured personal server despite a challenge to that designation by the State Department, according to two sources familiar with the review.
The sources described the dispute over whether the two emails were classified at the highest level as a “settled matter.”
The agencies that owned and originated that intelligence – the CIA and National Geospatial-Intelligence Agency or NGA – reviewed the emails to determine how they should be properly stored, as the State Department took issue with their highly classified nature. The subject matter of the messages is widely reported to be the movement of North Korean missiles and a drone strike. A top secret designation requires the highest level of security, and can include the use of an approved safe.
The sources, who were not authorized to speak on the record, told Fox News that while the emails were indeed “top secret” when they hit Clinton’s server, one of them remains “top secret” to this day -- and must be handled at the highest security level. The second email is still considered classified but at the lower “secret” level because more information is publicly available about the event.

As a reminder, over 1000 classified emails have been found on HRC's home-brew server...

The media machine has already proven it will do everything in its power to prevent that from happening. They've done everything in their power to convince people Hillary has some huge lead when that simply isn't the case. I think Bernie supporters will be much more motivated to show up in January than Hillary supporters, simply because many of them are probably assuming she'll win regardless. It would be nice if the DOJ prosecuted her, as that would essentially hand Bernie the nomination. Plus, she's earned it anyways...

And if he wins the nomination, I think he takes the presidency in a landslide victory. There are quite a lot of people who regard FDR as one of the greatest presidents of all time, and he was also a democratic socialist, so I think that will be an easy obstacle to overcome. Obviously the dominant majority of this board fall to the right, but that is not an accurate representation of the American public opinion as a whole. His platform is made up of positions that are supported by the majority of Americans, and his rallies and fundraising record prove that. He has kept up with the major candidates without a super PAC, which proves that the support is there and in large numbers. I've seen him personally, and can also tell you that his supporters are extremely passionate about these issues, which hopefully will be reflected by the voter turnout in January.

There will be a long line of people ready to vote for anybody against Jeb or Trump if they take the nomination for the GOP. Same could probably be said of Ted Cruz or Marco Rubio. & Ben Carson is a walking punch line so I'm rooting for him to just pave an easy path to the White House.

TBH I'm pretty torn. If Bernie supporters actually show up to vote he could take the primary and then the presidency. Frankly I wouldn't be that surprised if he won by a narrow margin and the DNC gave him the shaft.

One thing is for sure; Sanders is about action. It may not be the "best" action, if you don't like what he plans to do. But, he's not beholden to the same group of shysters that people like Clinton are in-bed with. I think the DNC is afraid of Sanders because he would upset the apple cart too much. They'd get real cosy, real quick with their alleged "conservative" opposition if someone were going to break the game board. Ron Paul was doing that for 8 years. The last thing the majority of DC criminals want is for someone to actually DO something. That f*cks it all up! Especially if it's doing something that unites the "sides" in the public aspect.

More than 100 days after he invoked his Fifth Amendment right to avoid testifying before the House committee investigating the Benghazi terrorist attack, a key Hillary Clinton aide is at the center of the separate and ongoing investigation by the FBI into Clinton’s use of a private unsecured server while she was secretary of state.
That former staffer, Bryan Pagliano, set up the controversial private email server in Clinton’s home in Chappaqua, N.Y.
Pagliano is believed to be the only witness publicly identified during the politically charged hearings on Benghazi to invoke the Fifth Amendment.
He has not been charged with any crime, but the investigation continues into how Clinton used a private homebrew server which contained highly classified information while she was secretary of state.
As Fox News was first to report on Dec. 15, a review by the intelligence community reaffirmed that at least two emails were “top secret” when they hit Clinton’s private server. The State Department had challenged the classification.
At the core of the separate FBI investigation is whether highly classified information was "grossly mishandled" by Clinton and her aides.
Pagliano worked for the Clinton campaign team and was their trusted IT specialist before he joined the State Department in May 2009.
As first reported by The Washington Post, the Clintons paid Pagliano $5,000 for "computer services" prior to his joining the State Department, according to a financial disclosure form he filed in April 2009.
Yet, even after arriving at State in May 2009, Pagliano continued to be paid by the Clintons to maintain the non-secure homebrew server, which was located in a bathroom closet inside the Clinton's Chappaqua home.
As part of invoking his Fifth Amendment right, Pagliano is also invoking the so-called act-of-production privilege. Since 1984, according to a review by Fox News, the privilege has been used in 103 federal or state cases.
A person can invoke his Fifth Amendment rights against the production of documents only where the act of producing the documents is incriminating in itself. According to a legal review by Fox News, this privilege applies when producing the documents – as opposed to their contents -- to the government is entitled to Fifth Amendment protection.
This assertion is tantamount to the defendant's testimony that the documents exist, are authentic and are in his possession.
The privilege has been invoked before by a Clinton associate. Webb Hubbell, Hillary Clinton's former law partner when she worked at the Rose Law Firm in Arkansas, argued for an "act-of-production privilege" during the federal investigation into the collapse of Madison Guaranty, a failed savings and loan. Hubbell followed Bill and Hillary Clinton into the White House to become an associate attorney general, the third-ranking member of the Justice Department. He was convicted in 1995 and served 18 months in federal prison for his role in the failure of that savings and loan which later became known as the "Whitewater scandal."

Hillary doesn't have many friends at all- just people who have bought her services. She's running neck and neck with Trump now- they need someone who they can buy who will also get elected.

Biden is a better option for the people who buy politicians and Hillary doesn't have any friends to keep her out of trouble.

However, one email thread from June 2011 appears to include Clinton telling her top adviser Jake Sullivan to send secure information through insecure means.

In response to Clinton's request for a set of since-redacted talking points, Sullivan writes, "They say they've had issues sending secure fax. They're working on it." Clinton responds "If they can't, turn into nonpaper [with] no identifying heading and send nonsecure."

Ironically, an email thread from four months earlier shows Clinton saying she was "surprised" that a diplomatic oficer named John Godfrey used a personal email account to send a memo on Libya policy after the fall of Muammar Qaddafi.

The latest batch of emails released from Hillary Clinton's personal account from her tenure as secretary of state includes 66 messages deemed classified at some level, the State Department said early Friday.

All but one of the 66 messages released in the early hours Friday have been labeled "CONFIDENTIAL", the lowest level of classification. The remaining email has been labeled as "SECRET." The total number of classified emails found on Clinton's personal server has risen to 1,340 with the latest release. Seven of those emails have been labeled "SECRET." Two of those emails have been labeled "TOP SECRET."

In all, the State Department released 1,262 messages in the early hours of Friday, making up almost 2,900 pages of emails."

They are recovering additional classified information from her home-brew server hard drives, emails that HRC stated her aides deleted and were never turned over to Dept of State. HRC is in some pretty deep $#!t.

The big question is what will Lynch do? Will she prosecute? If she doesn't, law enforcement predicts there will be a huge revolt within the FBI and she will either be forced to resign or there will be a major purge of law enforcement officials from the Bureau. In that case, this would be the biggest thing since Watergate.

In either case, it is by definition Secret or Top Secret Sensitive Compartmentalized Information (S/SCI or TS/SCI)...
 
EXCLUSIVE: The FBI investigation into Hillary Clinton’s use of private email as secretary of state has expanded to look at whether the possible “intersection” of Clinton Foundation work and State Department business may have violated public corruption laws, three intelligence sources not authorized to speak on the record told Fox News.
This track is in addition to the focus on classified material found on Clinton’s personal server.
"The agents are investigating the possible intersection of Clinton Foundation donations, the dispensation of State Department contracts and whether regular processes were followed," one source said.
The development follows press reports over the past year about the potential overlap of State Department and Clinton Foundation work, and questions over whether donors benefited from their contacts inside the administration.
The Clinton Foundation is a public charity, known as a 501(c)(3). It had grants and contributions in excess of $144 million in 2013, the most current available data.
Inside the FBI, pressure is growing to pursue the case.
One intelligence source told Fox News that FBI agents would be “screaming” if a prosecution is not pursued because “many previous public corruption cases have been made and successfully prosecuted with much less evidence than what is emerging in this investigation.”

EXCLUSIVE: Hillary Clinton's emails on her unsecured, homebrew server contained intelligence from the U.S. government's most secretive and highly classified programs, according to an unclassified letter from a top inspector general to senior lawmakers.

Fox News exclusively obtained the unclassified letter, sent Jan. 14 from Intelligence Community Inspector General I. Charles McCullough III. It laid out the findings of a recent comprehensive review by intelligence agencies that identified "several dozen" additional classified emails -- including specific intelligence known as "special access programs" (SAP).

That indicates a level of classification beyond even “top secret,” the label previously given to two emails found on her server, and brings even more scrutiny to the presidential candidate’s handling of the government’s closely held secrets.

“To date, I have received two sworn declarations from one [intelligence community] element. These declarations cover several dozen emails containing classified information determined by the IC element to be at the confidential, secret, and top secret/sap levels,” said the IG letter to lawmakers with oversight of the intelligence community and State Department. “According to the declarant, these documents contain information derived from classified IC element sources.”

Intelligence from a "special access program,” or SAP, is even more sensitive than that designated as "top secret" – as were two emails identified last summer in a random sample pulled from Clinton's private server she used as secretary of state. Access to a SAP is restricted to those with a "need-to-know" because exposure of the intelligence would likely reveal the source, putting a method of intelligence collection -- or a human asset -- at risk. Currently, some 1,340 emails designated “classified” have been found on Clinton’s server, though the Democratic presidential candidate insists the information was not classified at the time.

The FBI is investigating whether members of Hillary Clinton’s inner circle “cut and pasted” material from the government’s classified network so that it could be sent to her private e-mail address, former State Department security officials say.

Clinton and her top aides had access to a Pentagon-run classified network that goes up to the Secret level, as well as a separate system used for Top Secret communications.

The two systems — the Secret Internet Protocol Router Network (SIPRNet) and Joint Worldwide Intelligence Communications System (JWICS) — are not connected to the unclassified system, known as the Non-Classified Internet Protocol Router Network (NIPRNet). You cannot e-mail from one system to the other, though you can use NIPRNet to send e-mails outside the government.

Somehow, highly classified information from SIPRNet, as well as even the super-secure JWICS, jumped from those closed systems to the open system and turned up in at least 1,340 of Clinton’s home e-mails — including several the CIA earlier this month flagged as containing ultra-secret Sensitive Compartmented Information and Special Access Programs, a subset of SCI...

“It takes a very conscious effort to move a classified e-mail or cable from the classified systems over to the unsecured open system and then send it to Hillary Clinton’s personal e-mail account,” said Raymond Fournier, a veteran Diplomatic Security Service special agent. “That’s no less than a two-conscious-step process.”

He says it’s clear from some of the classified e-mails made public that someone on Clinton’s staff essentially “cut and pasted” content from classified cables into the messages sent to her. The classified markings are gone, but the content is classified at the highest levels — and so sensitive in nature that “it would have been obvious to Clinton.” Most likely the information was, in turn, e-mailed to her via NIPRNet.

To work around the closed, classified systems, which are accessible only by secure desktop workstations whose hard drives must be removed and stored overnight in a safe, Clinton’s staff would have simply retyped classified information from the systems into the non-classified system or taken a screen shot of the classified document, Fournier said. “Either way, it’s totally illegal.”

The FBI is going straight to the source in its investigation of classified emails that crossed Hillary Clinton’s personal server, speaking with the intelligence agencies – and in some cases, the individuals – that generated the information, two intelligence sources familiar with the probe told Fox News.
Investigators are meeting with the agencies and individuals to determine the classification level in the emails. The step speaks to the diligence with which the bureau is handling the investigation, despite the former secretary of state’s claims that the matter boils down to a mere interagency dispute.
"This is not merely a difference of opinion between the State Department and the Department of Justice," one intelligence source, who is not authorized to speak on the record, told Fox News, referring to comments on the Sunday talk shows and by the Clinton campaign downplaying the FBI's investigation. "The bureau will go directly to depose specific individuals in agencies who generated the highly classified materials."
The source added, "At the end of the day it will be a paper case. Emails never disappear because computers never forget.”
A former senior FBI intelligence officer, while not directly involved in the Clinton email investigation, previously told Fox News it was standard practice for the bureau to go directly to the originating source because it is cleaner and maintains the integrity of the investigation.

The discussion of a foreign national working with the U.S. government raises security implications – an executive order signed by President Obama said unauthorized disclosures are “presumed to cause damage to the national security."
