NSA has surveillance recordings of both the phone conversations AND any and all communications held within the Oval Office. The recordings exist. Comey knows that. That is why he was forced to confirm under oath what Trump claimed and what Comey had told the Gang of Eight - that Trump was never under FBI investigation.

A quick search reveals that Mueller's law firm also represents Ivanka Trump, Jared Kushner, and Paul Manafort. The people closest to Trump obviously believe that attorneys can be impartial when practicing law. To follow your criticism through to its logical conclusion, no prosecutor who has ever held a political opinion would be allowed to prosecute anybody who held a conflicting political opinion.
Incidentally, Mueller's only political donation of record was to a Republican and he was nominated to be director of the FBI by a Republican president. I'm sure there's a spin for that, too.
My position is that I'm not an attorney, and neither are you as evidenced by your attempt to compare a traffic violation to a criminal (or is it civil?) offense. My position is that Comey must have referenced intent because there was some legal significance to it. My position is that Comey only had the power to recommend a DOJ investigation, yet none of the imminently qualified attorneys at the DOJ sought prosecution either. I'm going to rely on the experts here, knowing that politics played a role in the decision without suggesting it played the only role.
What's ironic is that intent is precisely the question for the Russiaphobia that's gripping the nation (or at least half of the nation). Trump and several of his associates obviously had contacts with Russian players. That alone isn't evidence of guilt. What matters is the intent and context of those interactions.
